THEORETICAL AND LEGAL PRINCIPLES AND MAIN AREAS FOR ACTIVITY OF THE STATE MIGRATION SERVICE OF UKRAINE AS A SUBJECT OF INDIVIDUAL PREVENTION OF CRIMINAL OFFENSES

The article examines the theoretical and legal principles and main areas for activity of the State Migration Service (SMS) of Ukraine as a subject of individual prevention of criminal offenses. It is substantiated that in the conditions of intensification of migration processes, the spread of illegal migration, the use of forged documents and the unregulated legal status of certain categories of foreigners and stateless persons, the importance of the preventive function of the SMS of Ukraine in ensuring the security of the state and society is increasing. It was determined that individual prevention in the activity of the State Migration Service of Ukraine has a personalized nature and is aimed at identifying persons whose behaviour, legal status or social ties may indicate criminogenic risks. It was emphasized that such activities are implemented by verifying the legality of the stay of foreigners and stateless persons in Ukraine, identifying the facts of the use of forged documents, conducting preventive and explanatory work, applying administrative and legal response measures, as well as participating in the procedures of forced return and expulsion. It was found that the effectiveness of individual prevention in the migration sphere depends on proper interagency interaction of the State Migration Service of Ukraine with the National Police of Ukraine, the Security Service of Ukraine, the State Border Guard Service of Ukraine, social protection bodies and other prevention subjects. Based on the generalization of statistical and practical materials, it was proven that measures of migration control, identification, entry ban, forced return and expulsion are important tools of individual criminological prevention. It is concluded that it is advisable to consider the State Migration Service of Ukraine not only as an administrative management body in the field of migration, but also as an important element of the system of individual prevention of criminal offenses.
