CERTAIN ASPECTS OF LEGAL REGULATION OF LABOR MEDIATION (IN LABOR DISPUTES)

The article discloses important legal aspects of the implementation of international norms in Ukrainian legislation, improvement of Ukrainian legislation on labor mediation (in labor disputes), aspects of the implementation of labor mediation. The authors analyzed international documents, in particular, the ILO Convention No. 154 on the Promotion of Collective Bargaining of 1981, the Convention No. 151 concerning Protection of the Right to Organise and Procedures for Determining Conditions of Employment in the Public Service, Collective Agreements Recommendation No. 91, Recommendation on voluntary conciliation and arbitration No. 92, Collective Bargaining Recommendation No. 163, the legislation of Ukraine, draft laws, research by scientists on the legal regulation of mediation in collective and individual labor disputes, at the workplace. The authors found out that the concept of "labor mediation" according to the professional standard contains a broader interpretation than in the draft law of Ukraine "On collective labor disputes", so they proposed to define a single concept of "labor mediation". The authors analyzed the Labor Code of Ukraine, the draft laws "On Collective Labor Disputes" and "On Collective Agreements and Contracts", provided recommendations on amendments to the Labor Code of Ukraine regarding the inclusion of a mediation clause in the content of the contract, employment contract, student employment contract, employment contract with unfixed working hours, collective agreement, mediation clause agreement.
