THE IMPLEMENTATION OF THE RIGHT TO EMPLOYMENT UNDER CONDITIONS OF LABOR PRECARIZATION

Abstract

The article provides a comprehensive scientific and legal analysis of the implementation of the right to employment under conditions of labor precarization as one of the key trends in the development of modern social and labor relations. The study is based on an understanding of labor market transformations caused by globalization processes, digitalization of theeconomy, the development of platform-based employment, and the spread of non-standard forms of work. It is substantiated that these processes, while increasing employment flexibility, are accompanied by a decrease in job stability, weakening of social guarantees, and growing legal uncertainty regarding workers' status. The study reveals the essence of labor precarization as a systemic phenomenon that transforms traditional perceptions of employment, changes its content, and affects the effectiveness of the realization of this socio-economic right. It is argued that under the conditions of the spread of unstable, temporary, remote, and platform-based forms of employment, the right to employment gradually loses its guaranteeing character, turning into a formal opportunity to access work without an adequate level of social protection. The existence of a gap between the normative consolidation of this right and the actual conditions of its implementation is established.Particular attention is paid to the analysis of problems in the legal regulation of employment in Ukraine, including the fragmentation of the regulatory framework, its insufficient adaptation to modern forms of work organization, and the absence of clear criteria for identifying precarious forms of employment. Emphasis is placed on the impact of the platform economy, which leads to the emergence of new models of labor activity that do not always meet the classical characteristics of employment relationships. It is concluded that ensuring the effective realization of the right to employment requires rethinking its content from a human-centered perspective, improving the system of legal guarantees,and adapting labor legislation to the conditions of the modern labor market. The necessity of developing a comprehensive model of legal regulation of employment aimed at balancing economic flexibility and workers' social protection is substantiated.
