EUROPEAN INTEGRATION TRANSFORMATIONS OF THE CIVIL SERVICE AND THEIR IMPACT ON THE REALIZATION OF THE RIGHT TO WORK

Abstract

The article examines the European integration transformations of the civil service in Ukraine and their impact on the realization of the right to work. It is substantiated that modern changes in the field of civil service occur under the influence of the adaptation of national legislation to the standards of the European Union, which leads to a reconsideration of the legal nature of the civil service as a specific form of professional activity within which the right to work is exercised. It is established that the right to work in the civil service is complex, encompassing not only access to service but also proper working conditions, professional development, and social protection. The main trends in the development of legal regulation of the civil service in the context of European integration are analyzed, in particular, the extension of general labor guarantees to civil servants, clarification of their legal status, and transformation of the system of social guarantees. It is determined that these changes contribute to the gradual convergence of public service and labor relations and to the formation of a new model of civil service focused on ensuring human rights. Particular attention is paid to the influence of the principles of good governance and acquis communautaire on the development of the civil service, thereby contributing to increasing legal certainty, transparency, and efficiency of public administration. The importance of professionalization of the civil service, development of human resources, and continuous professional training as components of the realization of the right to work is considered. The need to ensure a balance between the specific restrictions inherent in the civil service and the guarantees of the right to work is emphasized. It is concluded that European integration transformations of the civil service shape new approaches to the realization of the right to work in the public sector and act as an important factor in improving the legal regulation of service-labor relations.
