EQUAL RIGHTS AND OPPORTUNITIES, SOCIAL JUSTICE AND GENDER EQUALITY AS FUNDAMENTAL PRINCIPLES IN THE FIELD OF THE RIGHT TO REMUNERATION AND LABOUR MOBILITY IN THE EU IN THE CONTEXT OF UKRAINE’S EUROPEAN INTEGRATION AND IN THE LIGHT OF THE CONCEPT OF DECENT

The aim of this article is to identify certain issues relating to the insufficient effectiveness of the mechanism for realising the right to decent work (in particular, the right to fair remuneration and labour mobility) in the EU and Ukraine, as a candidate for EU membership, on the basis of equal rights and opportunities, social justice and gender equality; to develop theoretical, practical and legislative proposals that could contribute to resolving these issues. It has been established that social justice, equal rights and opportunities, and gender equality as key principles ensuring decent work – are recognised by both Ukraine and the EU.Ukraine has committed to upholding these principles under the Association Agreement with the EU. However, at the legislative level in Ukraine, particularly in the current Labour Code, these axiological values of decent work are not currently enshrined. Furthermore, the very concepts of ‘decent work’ and ‘decent working conditions’ have not been enshrined by the legislator in the codified act, which hinders the implementation of the Association Agreement with the EU. It is proposed to amend Part One of Article 1 of the Labour Code of Ukraine, ‘Objectives of the Labour Code of Ukraine’. It would be worth noting that one of the main objectives should be ‘the legal regulation of issues concerning the realisation of the right to decent work and the provision of contractual regulation of decent working conditions. It has been argued that courses on ‘EU Labour Law’ and ‘Legal Framework for Decent Work in the EU and Ukraine’ should be introduced as compulsory modules within the ‘International Law’ and ‘Law’ degree programmes, as future lawyers in Ukrainian law schools do not study such courses to a sufficient extent, nor are the decisions of the Court of Justice of the EU in relevant cases studied in sufficient detail
